By creating an account or otherwise using LeadSpark AI, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.
2. Service Description
LeadSpark AI is a software-as-a-service platform that helps marketing teams and agencies discover local business leads, enrich contact information, and generate AI-assisted outreach messages. Features and pricing may evolve as the product improves.
3. User Responsibilities
You are responsible for the information you enter, for using the platform in compliance with applicable laws, and for the outreach you send. Cold email and marketing communications are regulated in many countries — you agree to comply with the rules that apply to your recipients.
4. Acceptable Use
You agree not to use LeadSpark AI to send spam, deceptive or unlawful messages, harass individuals, infringe intellectual property rights, attempt to reverse engineer the service, disrupt its operation, or misuse AI-generated content in ways that violate applicable law or these terms.
5. Accounts
You must provide accurate information when creating an account and are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized access.
6. Billing and Subscriptions
Paid plans are billed in advance through our third-party payment provider on a recurring basis until cancelled. Prices, plan features, and usage limits are shown on the pricing page and may be updated with reasonable notice. Except where required by law, fees are non-refundable and unused portions of a billing cycle do not carry over.
7. Cancellation and Plan Changes
You can cancel or change your subscription at any time from your account. Cancellations take effect at the end of the current paid period; upgrades and downgrades take effect immediately with proration handled by our payment provider.
8. Intellectual Property
The LeadSpark AI platform, including its software, design, and content we create, is owned by LeadSpark AI and protected by intellectual property laws. You retain rights to the content you submit and to the outputs generated for your account, subject to these terms and the terms of underlying AI providers.
9. AI-Generated Content Disclaimer
LeadSpark AI uses artificial intelligence to generate suggested outreach messages and other content. AI outputs may contain inaccuracies and should always be reviewed by a human before being sent or shared. You are solely responsible for how you use AI-generated content.
10. Third-Party Services
The platform relies on third-party services for authentication, hosting, payments, AI inference, and email delivery. We are not responsible for the availability or content of those third-party services, and their use may be subject to their own terms.
11. Disclaimer of Warranties
LeadSpark AI is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the service will be uninterrupted, error-free, or that specific business outcomes will be achieved.
12. Limitation of Liability
To the maximum extent permitted by law, LeadSpark AI and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill arising from your use of the service. Our aggregate liability for any claim arising from the service will not exceed the amount you paid to us in the twelve months preceding the claim.
13. Termination
You may stop using LeadSpark AI at any time. We may suspend or terminate your account if you violate these terms, misuse the service, or if we are required to do so by law. Upon termination, your right to access the service ends, though certain sections of these terms will survive.
14. Changes to These Terms
We may update these Terms of Service from time to time. When we make material changes, we will update the effective date below and, where appropriate, notify you inside the product or by email. Continued use of the service after changes take effect constitutes acceptance of the updated terms.
